General terms and conditions of business

1. Scope

These General Terms and Conditions (GTC) apply to all deliveries from Maik Söllner (hereinafter referred to as the Seller) to consumers.

A consumer is any natural person who concludes a legal transaction for a purpose that cannot be predominantly attributed to his or her commercial or independent professional activity.

2. Contracting party

The purchase contract is concluded with Maik Söllner - Programming & Web Design, owner: Maik Söllner, Sportplatzstraße 1, 95176 Konradsreuth.

3. Conclusion of contract

3.1. The presentation of the products in the online shop does not constitute a legally binding offer, but merely an invitation to order.

3.2. By clicking the [Buy/order for a fee] button, you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order.

4. Right of withdrawal

4.1. If you are a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with the statutory provisions.

4.2. If you, as a consumer, exercise your right of withdrawal in accordance with section 4.1, you will have to bear the regular costs of return.

Cancellation policy

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period shall be fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the goods.

To exercise your right of withdrawal, you must inform us [enter name of entrepreneur, address, telephone number and email address] of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form for this purpose, but this is not mandatory. You can also electronically complete and submit the model withdrawal form or another clear statement on our website (insert internet address). If you make use of this option, we will immediately send you a confirmation of receipt of such a withdrawal (e.g. by email).

To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the expiry of the cancellation period.

Consequences of revocation

If you cancel this contract, we will refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us or to (where applicable, the name and address of the person authorized by you to receive the goods) promptly and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. This deadline is met if you send the goods before the expiry of the fourteen-day period.

You shall bear the direct costs of returning the goods.

You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.

5. Prices and shipping costs

5.1. The prices listed on the product pages do not include statutory VAT or other price components in accordance with the small business regulation under Section 19 of the German Value Added Tax Act (UStG). In accordance with the small business regulation under Section 19 of the German Value Added Tax Act (UStG), none of the amounts shown include VAT.

5.2. In addition to the stated prices, we charge shipping costs per order for delivery within Germany. Shipping costs are clearly stated on the product pages, in the shopping cart, and on the order page.

6. Delivery

6.1. Delivery is only possible within Germany via DHL or Deutsche Post.

6.2. Delivery time is between 2 and 5 days, depending on the shipping method chosen. Any deviations will be indicated on the respective product page. The exact delivery times are listed again for each shipping method.

7. Payment

7.1. Payment is made exclusively via PayPal.

PayPal

To pay the invoice amount via the payment service provider PayPal (Europe) S.à rl et Cie, SCA, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your login details, and confirm the payment order. The payment transaction will be processed by PayPal after the goods have been shipped. Further information will be provided during the ordering process.

PayPal may offer additional payment methods in the customer account to registered PayPal customers selected according to its own criteria. However, we have no influence on the availability of these methods; additional individually offered payment methods affect your legal relationship with PayPal. Further information on this can be found in your PayPal account.

Payment processing through PayPal Services

In cooperation with the payment service PayPal, we offer you various payment methods as PayPal Services. You do not need to be registered with PayPal to pay the invoice amount. Depending on the selected payment method, you may be redirected to the PayPal website and the selected payment service after placing your order:

Credit card: During the ordering process, you provide your credit card information. The payment transaction will be processed immediately after confirmation of the payment order and after you have been verified as the legitimate cardholder by your credit card company at PayPal's request, and your card will be charged.

Giropay: On the PayPal website, you can enter your payment details and confirm PayPal's use of your data. You will then be redirected to the website of paydirekt GmbH, Stephanstr. 14-16, 60313 Frankfurt am Main ("Giropay"). To pay the invoice amount via Giropay, you must have a bank account activated for online banking, verify your identity, and confirm the payment order. Your account will be debited immediately after you place your order.

Direct debit: On the PayPal website, you can enter your payment details, confirm PayPal's use of your data, and confirm the payment order to PayPal. By confirming the payment order, you grant PayPal a direct debit mandate. PayPal will inform you of the date your account will be debited (so-called prenotification). Upon submitting the direct debit mandate immediately after confirming the payment order, PayPal will request your bank to initiate the payment transaction. The payment transaction will be processed, and your account will be debited.

Sofort by Klarna: On the PayPal website, you can enter your payment details and confirm PayPal's use of your data. You will then be redirected to the website of the online provider Sofort GmbH, Theresienhöhe 12, 80339 Munich ("Sofort"). To pay the invoice amount via Sofort, you must have a bank account activated for online banking, verify your identity, and confirm the payment order. Your account will be debited immediately after you place your order.

8. Retention of title

The goods remain our property until full payment has been made.

9. Warranty for material defects

DemoShop is liable for material defects in accordance with the applicable statutory provisions, in particular Sections 434 et seq. of the German Civil Code.

10. Dispute resolution

The EU Commission has created an internet platform for online dispute resolution. The platform serves as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
